Legal notices

Notices, terms, and policies. In plain language.

Maintained by Prevouched, Inc.. Material changes are announced in the changelog with effective dates. Where the membership agreement or an engagement contract is more specific, the contract governs.

L-01

Endorsement scope

The Prevouched trust mark is a point-in-time, revocable endorsement issued by Prevouched against a published rubric. It is not a certification, accreditation, warranty, insurance policy, surety bond, indemnity, or guarantee of any specific engagement outcome.

The mark asserts that on the date stamped on the verification page, the holder cleared each pillar of the rubric version recorded at or above the published pass bar for the tier shown. It asserts nothing further.

L-02

Money flow & contracting posture

Prevouched, Inc. invoices member agencies for membership fees and, where applicable, bounded success fees. Prevouched, Inc. is not a party to the agreement between an agency and its client and does not process delivery payments.

The single exception is the Managed-tier opt-in prime/SLA layer, which is a separate, legally reviewed per-engagement contract, priced for the additional accountability Prevouched assumes. Absent that explicit opt-in, Prevouched holds no payee position on any client contract.

L-03

Revocation, suspension & appeals

Prevouched may suspend or revoke any trust mark at any time on the grounds enumerated in the rubric. Material misrepresentation, undisclosed material subcontracting, repeated SLA breach, security incident materially affecting a client, failed periodic re-attestation, or a court order or regulatory action.

Suspended and revoked agencies are removed from the directory and reflected on the public verification page within 15 minutes of the decision. Holders may appeal under the procedure published in §10 of the rubric; appeals are reviewed by a partner who did not work the underlying file.

L-04

Use of the mark

Holders in good standing are granted a non-exclusive, non-transferable, revocable license to display the Prevouched trust mark via the official embed only. Static reproductions that do not call the verification endpoint are prohibited, including in PDF proposals, slide decks, and screenshots presented as live status.

Use of the mark by an applicant, suspended holder, or revoked holder is a material breach of the membership agreement and is grounds for permanent disqualification of the responsible principals.

L-05

Data handling

Vetting evidence. Including reference transcripts, security baseline responses, redacted case studies, and per-pillar scoresheets. Is retained for the membership term and a reasonable post-termination period for audit.

Buyer intro requests submitted through the directory are shared only with the requested agency and the assigned Prevouched liaison. Aggregate, non-identifying intro and outcome data may inform rubric calibration; identifiable data is not sold and is not shared with third parties outside the matched engagement.

L-06

Trademarks & attribution

“Prevouched”, the Prevouched mark, the verification badge, and the rubric framework are trademarks of Prevouched, Inc.. Agency names and marks displayed in the directory are the property of their respective owners and are used solely to identify the credentialed holder.

Press, analyst, and editorial use of the Prevouched name is permitted in factual reference; commercial use of the mark or its verification surface in derivative products requires written permission.

L-07

Disclaimers & limitation of liability

Prevouched provides the directory, verification surface, and liaison services on an as-is basis except where the membership or engagement contract expressly states otherwise. To the maximum extent permitted by law, Prevouched's aggregate liability arising from the mark or the directory is capped at the membership fees paid in the preceding twelve months.

Nothing in this disclaimer limits liability that cannot be limited under applicable law, including fraud, willful misconduct, or statutory liability that cannot be waived.

L-08

Governing law & jurisdiction

These notices, the membership agreement, and any engagement contracts with Prevouched, Inc. are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws provisions.

Disputes shall be brought exclusively in the state or federal courts located in Wilmington, Delaware, except where binding consumer protection law of a holder's or client's home jurisdiction requires otherwise.

L-09

DMCA & content complaints

Prevouched respects intellectual property rights. Notices of alleged infringement on the directory or any Prevouched-hosted surface may be sent to the designated agent identified on the contact page, with the elements required by 17 U.S.C. § 512(c)(3).

Counter-notices and good-faith disputes follow the DMCA process. Repeat infringers will have content removed and, where applicable, lose access to Prevouched services.

L-10

Changes to these notices

Material changes to the rubric, the revocation policy, or these notices are announced in the changelog with the effective date and, where applicable, a re-attestation window for affected holders.

Continued use of the Prevouched services after the effective date constitutes acceptance of the updated terms by holders in good standing.

Legal correspondence. Including DMCA notices, regulator inquiries, and subpoenas , should reach the designated agent via the contact page. Please mark sensitive correspondence “Legal. Attention designated agent.”
